Steps

Electronically through ePermit

  1. 1

First check whether the building meets the basic condition

An application is possible only for an unlawfully constructed or reconstructed building completed by 21 June 2011 that meets the statutory conditions and can be evidenced by the prescribed orthophoto map or other official record.

  2. 2

Engage authorised professionals for the documentation

Engage an authorised surveying engineer for the survey and an authorised architect or civil engineer for the record of completed state. For a completed building, obtain the required statement on stability as well.

  3. 3

Prepare digital attachments and special consents

Attachments are submitted electronically. Where special restrictions apply, obtain cultural-heritage confirmation, Croatian Waters consent, or consent of the manager or owner of the public surface before submitting.

  4. 4

    Submit the application through ePermit

In ePermit, select the application for a decision on completed state, upload complete documentation and submit it to the competent municipal, city or county authority.

  5. 5

Pay the fee when the conditions for the decision are met

Before the decision is issued, pay the fee for retaining the unlawfully constructed building in space, or the first instalment if instalment payment is approved. The authority reviews the attachments and may perform an inspection.

  6. 6

Collect the decision and check related registrations

After the decision is issued, the cadastral office records the building and sends the decision with prescribed documents to the land-register court. Check whether additional actions and charges apply in your case.

Important notes

  • Removing the submission deadline does not mean every building can be legalised: the construction or reconstruction date by 21 June 2011 and all other statutory conditions remain essential.
  • A decision on completed state does not resolve ownership, disputes or all location and technical conditions; it does not replace a building permit for new works.
  • If a dispute protecting ownership or another real right in the building or land was started before submission, the procedure is suspended until it ends, except in the statutory exception.
  • Do not start new works assuming that the decision on completed state will cover them.

Common mistakes

  • Preparing an application for a building constructed after 21 June 2011.
  • Trying to submit the application without electronically signed professional attachments.
  • Overlooking a special consent required for water property, a public surface or protected cultural property.
  • Confusing a decision on completed state with proof of ownership or permission for a future extension.
